1868 - Indenture of property in Buller's Row, Redruth:

This Indenture made the first day of August in the year of our Lord one thousand eight hundred and sixty eight BETWEEN James Howard Buller of Downes in the County of Devon Esquire of the one part and Mary Ripper Broad of the Parish of Redruth in the County of Cornwall Widow of the other part WITNESSETH that for and in consideration of the surrender of a certain Indenture
of Lease of the premises hereinafter appointed made and granted by James Wentworth Buller (since deceased) to the said Mary Ripper Broad for a term of ninety nine years determinable as therein mentioned and of they early rent covenants and conditions and agreements hereinafter reserved expressed and contained on the part of the said Mary Ripper Broad her
executors administrators and assigns to be paid done and observed and performed He the said Howard Buller HATH appointed and also granted demised and leeased and by these presents DOTH appoint and also grant demise and lease Unto the said
Mary Ripper Broad her executors administrators and assigns ALL that plot or piece of ground situate in Buller's Row in Redruth aforesaid being about thirty six feet wide and one hundred and three feet long bounded on the north west by James Hockings
house and gardens south east by the late John Martin Tresidder's house and south west by a meadow belonging to William Davey and north east by the wall or palisades in front of the house built on the said plot of ground hereby demised together with
all houses and buildings erected on the saidpiece or plot of ground with the appurtenances to the same belonging And also all that plot of ground with a row of houses built thereon now in the possession of the said Mary Ripper Broad or or her undertenants lying near the turnpike road leading from Redruth to the South Turnpike Gate near the stamps being the
premises assigned by Phillipa Hosking to Humphrey Broad the late husband of the said Mary Ripper Broad by indenture bearing date the <.....blank....> day of May one thousand eight hundred and thirty three Except out of this present grant and demise unto the said James Howard Buller his heirs and assigns All his toll tin lead copper and copper ore and all Mines Metals
Minerals and quarries of stone clay and marle whatsoever now found digged or wrought
or hereafter to be found digged or wrought in or upon the said premises or any part thereof And also all trees and saplings whatsoever now growing or hereafter to grow in or upon the said premisesor any part thereof And also excepting all and every stream and streams of water and watercourses whatsoever arising running or flowing in or upon the said premises together with free liberty of ingress egress and regress unto and for the said James Howard Buller his heirs and assigns and his and their workmen servants and agents to dig delve work and search for tin copper lead and other metals and minerals and quarries of stone clay and marle and the same there found to break bring to grass dress and make merchantable and from thence to take and carry away the same And to erect and make any engines stamping mills sheds hovels or other edifices upon the said premises for the better discovering and working any such mines as aforesaid or making the ore thereof merchantable and to cut down and carry away any trees now growing or to grow on the said premises
And also to divert and turn the said waters and to cut passages for the same for conveying thereof from place to place in or upon the said premises or elsewhere when and as often as he or they shall think fit and at his or their will and pleasure And also excepting all royalties whatsoever TO HAVE AND TO HOLD all and singular the said premises hereby demised with the
appurtenances (except before excepted) unto the said Mary Ripper Broad her executors administrators and assigns from henceforth for and during the full time and term of of ninety nine years hence not ensuing and fully to be complete and ended If
the said Mary Ripper Broad now aged about sixty years and Elizabeth Ripper Wilton now aged about thirty three years daughter of the said Mary Ripper Broad or either of them shall so long happen to live She the said Mary Ripper Broad her executors administrators and assigns YIELDING AND PAYING therefore yearly and every year during the said term the yearly rent or the
sum of two pounds and two shillings of lawful British money (clear of all outgoings whatsoever) at the four most usual feasts or days of payment of rent in the year (that is to say) Christmas day Lady Day Midsummer-day and Michaelmas-day by even and equal quarterly payments AND ALSO YIELDING AND PAYING the sum of five shillings of like lawful money at and upon the death or decease of each of them the said Mary Ripper Broad and Elizabeth Ripper Wilton the lives above named for and in the name of an heriot And also doing suit and service at all and upon every the courts to be held for the Manor of Tolgus and paying her and their proportionable part of the expenses of each and every such court or paying five shillings as an amercement for every default And also executing the office of Reeve for the said manor whenever thereto required AND the said Mary Ripper Broad doth hereby for herself her heirs executors administrators and assigns covenant promise and agree to and with the said James Howard Buller his heirs and assigns in manner following (that is to say) that she the said Mary Ripper Broad her heirs executors administrators and assigns shall and will well and truly pay or cause to be paid unto the said James Howard Buller his heirs and assigns the aforesaid clear yearly rent or sum of two pounds and two shillings in manner and form aforesaid And also shall and will well and sufficiently repair sustain maintain and keep all and singular the said premises as well in houses walls coverings hedges ditches gates stiles and fences and in all other needful and necessary reparations and amendments whatsoever during the said term and at the end of the said term or other sooner determination of this lease in good and complete order repair and condition shall and will leave and yield up the same unto the said James Howard Buller his heirs and assigns PROVIDED ALWAYS and it is hereby declared and agreed that if the said yearly rent or sum of two pounds and two shillings or any part thereof shall be behind and unpaid for the space of twenty days next after any or either of teh said feasts or days of payment whereon the same becomes due and ought to be paid as aforesaid And no sufficient distress during all that
time can or may be found in or upon the said premises whereby the rent with the arrears (if any) may be fully levied satisfied and paid together with the costs and charges of distraining for the same Or if the said Mary Ripper Broad her executors administrators or assigns do or shall permitor suffer the said demised premises or any part thereof to be out of repair to the
value of forty shillings and the same do not sufficiently amend and repair within three months next after notice to her or them given or left at her or their usual habitation or place of abode Or do or shall willingly or willingly commit or suffer or cause to be done committed or suffered any act matter or thing whatsoever which shall or may be hurtful or prejudicial to the title or estate
of inheritance of him the said James Howard Buller his heirs or assigns Or shall commit any wilful waste spoil or destruction on the said premises during the said term Or if any doubt shall arive (sic) touching the existence of either of the lives
above named on whose decease the said term is determinable and the said Mary Ripper Broad her executors administrators or assigns shall neglect or refuse to produce the person or persons concerning whom such question shall arise Or to make due proof of her or their existence on receiving six months notice in writing for that purpose from the said James Howard Buller His
heirs or assigns or his or their steward or agent Or shall not duly observe and perform all and every the covenants clauses articles and agreements herein expressed on her and their parts to be observed and performed That then and thereupon for all
any or either of the causes aforesaid it shall and may be lawful to and for the said James Howard Buller his heirs and assigns into and upon the said demised premises or into any part thereof in the name of the whole to re-enter and the same to have
again retain repossess and enjoy as in his or their former estate or right anything herein contained to the contrary thereof in anywise notwithstanding AND the said James Howard Buller doth hereby for himself his heirs and assigns covenant promise and agree to and with the said Mary Ripper Broad her executors administrators and assigns that it shall and may be lawful to
and for the said Mary Ripper Broad his (sic) executors administrators and assigns by and under the due payment of the said rent and observance and performance of the covenants conditions and agreements herein on her and their parts contained peaceably and quietly to have hold occupy possess and enjoy the said demised premises (except before excepted) ["after the commencement" has been crossed out] for and during the said term determinable as aforesaid without thelawful let suit trouble interruption hinderance (sic) claim entry or denial of the said James Howard Buller his heirs or assigns or of any other person or persons whomsoever claiming or to claim by from or under him them or any or either of them IN WITNESS whereof the said parties to these presents their hands and seals have hereunto set the day and year first above
